This information is addressed to entities and persons with whom 6Cube Sp. z o.o. with its registered office in Warsaw, 79 Ostrobramska St., 04-175 Warsaw (hereinafter: “6Cube”) maintains contacts in the course of its business activities. In connection with the application of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter: “RODO”), with a view to protecting the privacy of individuals, transparency in data processing and providing individuals with greater control over how their personal data is used, we inform you that:
1. 6Cube, in the course of its business activities, acting as a data controller, may process data:
a. contractors, suppliers including potential suppliers to 6Cube,
b. partners, employees, legal representatives, and representatives and agents of such contractors, including the contact persons indicated in the contracts.
2. 6Cube may process data provided directly by the contractor, such as:
a. Name, contractor’s name, business address, and other mailing addresses;
b. registration numbers indicated in the relevant registers;
c. contact information (telephone number, e-mail address, other addresses used in correspondence);
d. status data in the contractor structure (e.g.: function, position, scope of authority).
(3) 6Cube may also obtain additional information from publicly available sources, such as publicly available business registers maintained under the law (e.g. CEIDG, KRS) to the extent limited to the data disclosed in such registers.
(4) Where personal data is not provided directly by the subject, the source of the data is the contractor or other employee/co-worker of the contractor.
5. 6Cube may process the personal data of the persons referred to in paragraph 1:
a. where the data subject, pursuant to Article 6(1)(a) of the RODO, has voluntarily consented to the processing of his or her personal data for the purposes specified in the consent in each case. 6Cube stores this data until the consent is withdrawn. Please be advised that consent may be withdrawn at any time, whereby withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal;
b. when, in accordance with Article 6(1)(b) of the RODO, the processing of such data is necessary for the performance of the contract and the fulfillment of obligations arising from such contract (e.g. name, identification data such as PESEL, series and number of identity document, contact and registration data). Provision of data necessary for binding the contract or its execution and settlement is mandatory. For this purpose, 6Cube may process personal data during the duration of such contract and after its termination for the period necessary to establish, assert or defend claims;
c. if, pursuant to Article 6(1)(c) of the RODO, the processing of such data will be necessary for the performance of 6Cube’s legal obligations. Provision of data is mandatory, and the obligation arises from the law. For this purpose, 6Cube may store data for the duration of such obligation (e.g., data contained in invoices and documents confirming activities and transactions undertaken);
d. if the processing is necessary for the pursuit of 6Cube’s legitimate interests, where such interests are overridden by the interests or fundamental rights and freedoms of the data subjects, pursuant to Article 6(1)(f) of the RODO. Such legitimate interests are, for example:
(a) the establishment, investigation and defense of claims arising out of the business, and protection against such claims;
(b) conducting ongoing contacts and settlements;
(c) verification of the identity of persons acting on behalf of our contractors; 6Cube may process such data for the period necessary to establish, assert or defend claims.
6Cube may disclose personal information:
a. entities and persons acting for and on behalf of 6Cube – subcontractors of 6Cube;
b. state authorities, acting within the framework of their investigations;
c. to other entities, insofar as it is necessary for the performance of actions taken at the request of the data subject.
(7) In connection with cooperation with international partners, data may also be transferred outside the EEA. This possibility applies to entities supporting 6Cube’s systems, which guarantee a high degree of data protection resulting from the application of, among other things, standard contractual clauses adopted by the European Commission.
8. 6Cube does not process personal data by automated means.
(9) A person whose data is processed by 6Cube has the right to access the content of his/her data and the right to rectify, amend, erase, restrict processing, the right to data portability, the right to object, the right to withdraw consent at any time without affecting the lawfulness of the processing performed on the basis of consent before its withdrawal, in accordance with Article 15-22 of the RODO.
